Experience and Expertise

Frances has experience in enforcing and challenging the validity of consumer credit agreements. She is frequently instructed by mortgagees, mortgagors and third parties in litigation and in an advisory capacity.

Recent consumer credit experience includes advising on multiple agreements; advising and acting for creditors and borrowers in claims to enforce consumer credit agreements; and advising on exempt agreements under the Consumer Credit Act.

Recent mortgages experience includes acting for a mortgagee in a contested mortgage possession claim raising issues of undue influence, misrepresentation, non est factum and unconscionable bargain; acting for a third party in a claim to establish an overriding interest binding a mortgagee as a result of a sale and leaseback arrangement; acting in a claim concerning a regulated mortgage contract; acting in a claim against a mortgagee alleging a sale at an undervalue; and acting in professional negligence claims concerning negligent mortgage valuations and failure to adequately protect the lender’s interest.
