Our experience includes claims concerning breach of fiduciary duties, knowing receipt and dishonest assistance, asset recovery by tracing, and restitutionary remedies. This area can involve members acting on an urgent basis to protect the interests of clients by seeking interim relief such as freezing injunctions or search orders.
Members litigate and advise on the entitlement to, and range of remedies available in, debt recovery and the enforcement of judgment debts (including contested writs of fi fa, sequestration, possession and delivery, interpleader actions and charging orders). We are able to draw on our experience of matters involving insolvency, as well as addressing arguments on the limitation of actions.
