Regulatory Matters

Members of chambers provide advice and advocacy in respect of a wide range of regulatory matters including the investment of scheme assets, the actions of trustees, the Pensions Regulator’s “moral hazard” powers under the Pensions Act 2004 to issue contribution notices and to make financial support directions and clearance applications to the Pensions Regulator.

Our barristers have appeared before the Determinations Panel of the Pensions Regulator in cases concerning the appointment of independent trustees and the prohibition of trustees and have provided advice in respect of the enforceability overseas of FSDs and contribution notices and in scheme funding disputes.
