Non-Contentious Probate

Our members advise and appear in the Probate Registries, and before the Family Division Judges, in relation to all non-contentious probate business arising under the Non-Contentious Probate Rules 1987. Sometimes, such applications can be dealt with fairly informally, but on other occasions they are hotly contested. This work includes applications for the removal of caveats, applications for grants of administration ad colligenda bona, the resolution of disputes between persons entitled to a grant in the same degree, applications to pass over a potential personal representative under s 116 of the Senior Courts Act 1981 and applications for leave to swear death.
