Property Law Update

Members of Radcliffe Chambers will be hosting a Seminar on the  30th October looking at recent developments in the area of Property Law.

The evening will be chaired by Robert Pearce QC

Topics for discussion include:

Lender breach of trust claims                                                                     

Grant Crawford: AIB Group (UK) PLC v Mark Redler & Co. Solicitors UKSC 2013/0052 and  the basis for the quantification of the lender’s loss.
Peter Dodge: section 61 Trustee Act 1925 and the circumstances in which the court will  grant relief from liability to a lender’s solicitor who has paid away the mortgage monies in  breach of trust

Lessons from the recent Morshead Mansions litigation           

William Moffett: The Preparation of Service Charge Accounts: where law and accountancy collide.
Edward Hicks: Tenant owned landlord companies: raising funds from members as a  viable alternative to service charges

Adverse Possession                             

Simon Williams: Practical points on establishing possessory title to land.
Frances Ratcliffe: Best v Chief Land Registrar [2014] EWHC 1370 (Admin)What is the effect of criminalising trespass on a claim to adverse possession of registered land? What is the effect of article 8 ECHR and article 1 of Protocol 1 to the ECHR on a refusal to register title by adverse possession?
