Olivia Wilson (Pupil)

Olivia has been exposed to a variety of commercial matters during her pupillage so far, including:

• successfully applying for pre-action disclosure and having her costs awarded in departure of the usual rule.
• assisting Andrew Brown with drafting pleadings and advice for claims under a guarantee.
• Olivia also assisted in research, trial preparation and drafting for Andrew Brown in his successful High Court case Scotbeef Ltd v D&S Storage Ltd & Lonham Group Ltd [2024] EWHC 341 (TCC) which is only the third published judgment under the Insurance Act 2015.
• During Olivia’s first seat she also shadowed Jonathan Edwards at a trial over a bridging loan facility which included issues over whether the mortgage was a regulated loan, promissory estoppel, and unfair relationship under the Consumer Credit Act 1974.

During pupillage Olivia has gained exposure to various insolvency matters by shadowing Andrew Brown, including at:

• an application for an administration order which included navigating the issues of unlawful trading;
• a hearing for an underlying section 423 Insolvency Act 1986, transactions that intended to defraud creditors, claim and the case brought up issues of res judicata;
• a hearing for underlying section 212 Insolvency Act 1986 misfeasance and section 239 Insolvency Act preference claims;
• an application for a stay to proceedings against a Company in liquidation; and

Olivia has also drafted an opinion on potential constructive trusts in a bankruptcy setting.

In Olivia’s second seat of pupillage, she sat with Oliver Hilton and gained knowledge in various private client matters, including:

• claims under the Inheritance Act 1975, Olivia drafted a Part 8 claim form and witness statement, and calculated quantum for what reasonable financial provision might be;
• probate claims, Olivia drafted a letter before action and then the claim for rectification and construction of a will;
• trusts disputes, Olivia wrote an opinion on how to change the constitution of a trust to remove a custodian trusteeship of common land and the tax implications of changing the trust structure;
• Olivia has also shadowed Oliver Hilton in a multi-party mediation over the administration of an estate, which settled potential property, inheritance and will validity claims; and
• Olivia has also been exposed to professional negligence claims, assisting in drafting a letter before action.

Olivia has also spent time shadowing members of chambers to widen her knowledge of other areas of practice including pensions and charities work:

• Olivia shadowed Joshua Winfield at a hearing for cost consequences of a preliminary trial deciding whether a company was a charity, and subsequently permission to apply to bring ‘Charity Proceedings’ pursuant to section 115 Charities Act 2011.
• Olivia also shadowed Wendy Mathers led by Keith Rowley KC at a day of closing submissions in the reported pensions case Newell Trustees Ltd v Newell Rubbermaid UK Services Ltd.
• Olivia has also completed research tasks for Kate Rogers on prospective cost orders and the Pension Regulator’s power to appoint an independent trustee under section 7 Pensions Act 1995.
• Olivia has also shadowed the junior tenants at winding up petitions and bankruptcy hearings, as well as mortgage possession claims and hearings for extension of time to register a charge at Companies House.
