Severing Joint Tenancies
This session will discuss how joint tenancies can be severed; Problems with severance by notice; What kinds of course of dealings can amount to severance; How and when the consequences of survivorship on the death of a joint tenant can be reversed, including deeds of variation, insolvency applications and the Inheritance (Provision for Family and Dependants) Act 1975.
Challenging wills
This session will discuss the recent reported decisions on challenging a will on the grounds of testamentary incapacity, want of knowledge and approval, and revocation. In particular we will discuss the recent case of Clitheroe v Bond in which the Court considered the continued application of the Banks v Goodfellow test and invalidity of wills on the basis of insane delusions.
