Home 1
James Morgan KC
represented the successful claimant in Northampton Borough Council v Cardoza & Ors [2019] EWHC 26 (Ch), a high profile case concerning £10.25 million of loans made by the council to Northampton Town Football Club and the conduct of defendants, as the former directors of the club, in relation to those loans. Following a 10-day trial, HHJ Barker KC found that the former directors had acted in breach of their fiduciary duty and were liable to compensate the council as assignee of the club. He also granted the claimant relief under section 423 of the Insolvency Act 1986 in relation to the transfer by one of the defendants to his wife of an interest in their former domestic property.
