Matthew Mills, instructed by Luke Harrison and David Jones of Keidan Harrison LLP, appeared in reported charity proceedings Dasji v Bhudia [2026] EWHC 455 (Ch).
The case concerned a long-running dispute over the terms of a constitution of a substantial Swaminarayan Hindu Temple in London. The High Court was asked to resolve the dispute by making an administrative/ managerial scheme for the charity.
The judgment is important for charity law practitioners because it contains a detailed discussion of the court’s jurisdiction to make an administrative scheme: see [68]-[89]. It confirms the test which the court should apply, the factors which the court must consider, and the evidence which is most likely to be relevant.
The judgment also explains the role of the Attorney General in claims for a scheme: see [47]-[51].
