On Friday 10 December 2021, Mr Justice Leech handed down judgment in Chen v Chung (Re Li Shu Chung and Cross-Border Insolvency Regulations 2006) [2021] EWHC 3346 (Ch), recognising a Hong Kong bankruptcy under the Cross-Border Insolvency Regulations 2006. James Morgan KC and Katie Longstaff acted for the successful trustees in bankruptcy who managed to rebut the presumption of COMI following habitual residence by reference to the inconsistent information that the bankrupt had provided to his creditors in Hong Kong.
