Moorgate Industries UK Ltd v Mittal [2020] EWHC 1550 (Ch) – Article by Steven Barrett

Steven Barrett was recently invited by LexisPSL to consider the legal and practical ramifications of the decision in Moorgate Industries UK Ltd v Mittal [2020] EWHC 1550 (Ch). The case concerned the enforcement of commercial arbitration awards against third parties via a bankruptcy order of one of the world’s richest men. Mr Mittal had acted as guarantor for the debt arising from the award. It serves as an important reminder that the courts continue to make bankruptcy orders despite the coronavirus pandemic and that commercial arbitration awards will be upheld by the High Court. Radcliffe Chambers barrister Kate Rogers acted for the successful petitioner.
