Arbitration

We are committed to helping our clients solve their most difficult problems. Sometimes this means using our advocacy skills in litigation, but often it means resolving disputes outside of court, in a confidential forum. Arbitration is an ideal platform for this as it can be collaborative or adversarial, depending on the circumstances.

Many of our barristers have been instructed to represent clients in arbitration. They have particular strength in commercial, fraud matters many involving international clients and assets. Several of our barristers and associate members are accredited arbitrators also, which gives them insight into the process.

Expertise

  • Advising on a substantial and complex fraud relating to the fraudulent activities of partners in a JV for the creation of telecommunications infrastructure in the Balkans where the Claimant has suffered losses of €4m. The case was complex as it involved the EBRD that enjoys limited sovereign immunity and relates to a series of transactions in various jurisdictions around Europe. 
  • Advising on a complex and high value arbitration involving parties in Russia, Cyprus and the UK. The case involves an arbitration of an unfair prejudice petition under section 202 of the Cyprus Companies Law and relates to a major business operating in Russia. 

 

  • Acting for the large Middle East based conglomerate, in relation to a claim relating to the fraudulent preparation of accounts and other fraudulent misrepresentation made in connection with the Groups acquisition from the Defendants.

 

  • Acting for an Iranian insurance company in its claim against the respondent Singapore corporation for payment under a settlement agreement.  The claim turned on whether the respondent had made “reasonable efforts” to make payment under a sanctions clause designed to address the risk of exposure to US Secondary Sanctions under its Iran Sanctions Program. The proceedings included a number of contentious applications for the disclosure of US law advice obtained by the respondent.
