We represent clients in complex commercial contract disputes involving all aspects of contract law, including formation, interpretation, performance, breach and enforcement. We also advise on the drafting of various kinds of contract.
We have significant expertise in international disputes and have experience advising on the proper law governing a contract, the jurisdiction of the court to hear disputes, and the interpretation and effect of regulations and conventions concerning the jurisdiction and enforcement of judgments.
Our expertise includes issues of enforceability, such as misrepresentation, non-disclosure and mistake, as well as agreements that may have been procured by duress or undue influence. Frustration and force majeure and illegality (including the potential effect of international sanctions) also form a significant aspect of our work.
We have extensive experience in civil fraud cases, cases involving goods and services (including agency generally and the Commercial Agents Regulations), and cases arising in the insurance arena.
We also advise in relation to covenants restricting competition and the misuse of confidential information generally and also within an employment context, including questions of enforceability, claims for injunctions and other remedies.
